Terms of Service

1. General Provisions

1.1. These Terms of Service (hereinafter “Terms”) govern the mutual rights and obligations between California Foods s.r.o. (hereinafter “Provider”) and any natural or legal person who orders services through the website kitchenlaunchpad.cz (hereinafter “Customer”).

1.2. These Terms apply to all services offered on the website kitchenlaunchpad.cz, in particular consultation services, HACCP documentation generation, allergen table generation, the pricing calculator, and other related services.

1.3. By ordering any service, the Customer confirms that they have read and agree to these Terms.

2. Description of Services

The Provider offers the following services through the website kitchenlaunchpad.cz:

2.1. Consultation Services

• Initial Consultation (online) — a free 30-minute consultation focused on an initial analysis of the Customer’s food business idea, basic HACCP information, and Czech legislation overview.
• Business Consultation (online) — a paid expert consultation covering HACCP advisory, pricing, labelling, production planning, and other aspects of food business operations.
• In-Person Office Assistance — a paid service involving physical accompaniment and assistance with obtaining trade licences, business premises registration, and other official matters at Czech government offices.

2.2. HACCP Generator

An automated service for generating comprehensive HACCP documentation (critical control point plans) based on information provided by the Customer via a web form. The documentation is generated using artificial intelligence technology and is always produced in Czech, in accordance with Czech food hygiene legislation requirements.

2.3. Operating and Sanitation Rules (PSŘ)

An automated service for generating operating and sanitation rules based on information provided by the Customer via a web form. The documentation is generated using artificial intelligence technology in Czech.

2.4. Allergen Generator

An automated service for generating allergen tables and overviews for food business operations based on data provided by the Customer. The output serves as a basis for fulfilling the allergen information obligation under EU Regulation No. 1169/2011.

2.5. Food Pricing Calculator

A web application for calculating costs, margins, and selling prices of food products. The basic version (COGS calculator) is available free of charge. The PRO version (one-time payment of 490 CZK incl. VAT) includes extended features: variable and fixed overhead, PDF export, product saving, and custom branding.

2.6. Consultation Booking System

An online system for booking consultation appointments. The first consultation (30 minutes, online) is free of charge. Further consultations are charged according to the current price list.

3. Orders and Contract Formation

3.1. A contract for the provision of services is concluded at the moment the Customer completes an order on kitchenlaunchpad.cz and makes payment (for paid services), or confirms a reservation (for the free initial consultation).

3.2. Before completing an order, the Customer is obliged to verify the accuracy of all entered data. The Provider bears no responsibility for errors in documents resulting from incorrect input data provided by the Customer.

3.3. Upon successful acceptance of an order, the Customer will receive a confirmation at the email address provided during the order process.

4. Prices and Payment Terms

4.1. Pricing

Current service prices are listed on the Pricing page. All prices include VAT (the Provider is a registered VAT payer). The Provider reserves the right to change prices; the price valid at the time of order submission is always binding for the Customer.

4.2. Payment Methods

Payment for services can be made in the following ways:

• Online card payment — via the GoPay payment gateway (Visa, Mastercard, Google Pay, Apple Pay).
• Bank transfer — based on an issued invoice with payment details and a QR code for payment (SPAYD).

4.3. For online payments, the service is activated immediately upon confirmation of successful payment by the GoPay payment gateway. For bank transfers, the service is activated after the payment is credited to the Provider’s account.

4.4. The Provider will issue the Customer a tax document (invoice) in electronic form, which will be sent to the Customer’s email address.

5. Delivery Terms

5.1. Consultation Services

Online consultations take place via video call (e.g. Google Meet, Zoom) at the time agreed upon during booking. In-person office assistance takes place at a pre-arranged location and time.

5.2. HACCP Generator and Operating and Sanitation Rules

After successful payment and completion of the input form, the documentation is generated automatically. The typical generation time is up to 30 minutes. The generated document is delivered to the Customer in PDF format via email and is also available for download through the web interface.

5.3. Allergen Generator

After completion of the input form, the output is generated automatically, typically within a few minutes. The document is delivered in PDF format to the Customer’s email and is available for download on the website.

5.4. Pricing Calculator — PRO Version

After successful payment, the PRO version is activated immediately and permanently assigned to the Customer’s user account. This is a one-time payment with no recurring fees.

6. Withdrawal and Cancellation Policy

6.1. Statutory Right of Withdrawal (Consumers)

A Customer who is a consumer within the meaning of Section 419 of the Czech Civil Code has the right to withdraw from a contract concluded remotely without giving a reason within 14 days of the date of contract conclusion, in accordance with Section 1829 of the Czech Civil Code.

6.2. The Customer acknowledges that, in accordance with Section 1837(l) of the Czech Civil Code, it is not possible to withdraw from a contract for the provision of digital content if the digital content was delivered with the Customer’s prior express consent before the expiry of the withdrawal period. When ordering HACCP Generator, Operating and Sanitation Rules, Allergen Generator, and Pricing Calculator PRO services, the Customer expressly consents to the commencement of the service before the expiry of the withdrawal period and acknowledges that this results in the loss of the right to withdraw from the contract.

6.3. Consultation Cancellation

• Cancellation or rescheduling of a consultation is possible at least 24 hours before the scheduled time — free of charge.
• Cancellation less than 24 hours before the scheduled time incurs a cancellation fee of 50% of the consultation price.
• Failure to attend without prior notice results in a charge of the full consultation price.

6.4. Refunds

In the case of a legitimate withdrawal from the contract, funds will be returned to the Customer within 14 days of receipt of the withdrawal notice, using the same payment method by which they were received, unless the parties agree otherwise.

7. Rights and Obligations of the Provider

7.1. The Provider undertakes to deliver services with professional care, in accordance with current Czech legislation and within the agreed scope.

7.2. The Provider reserves the right to reject an order if the Customer provides clearly false or incomplete information, or if it is evident that the service is intended to be used in violation of the law.

7.3. The Provider is entitled to temporarily suspend the provision of services for maintenance, updates, or technical issues. The Customer will be informed of planned outages in advance where possible.

8. Rights and Obligations of the Customer

8.1. The Customer is obliged to provide truthful and complete information when placing an order.

8.2. The Customer is responsible for the accuracy and completeness of input data provided for document generation (HACCP plan, Operating and Sanitation Rules, allergen tables). The Provider is not liable for inaccuracies in documents caused by incorrect input data from the Customer.

8.3. The Customer acknowledges that the generated documents serve as a high-quality template and foundation. The Customer, as the food business operator, bears sole responsibility for their final implementation, updates, and practical compliance.

8.4. The Customer may not resell, distribute, or make the generated documents available to third parties for a fee without the prior written consent of the Provider.

9. Liability and Warranty Limitations

9.1. Documents generated through the HACCP Generator, Operating and Sanitation Rules, and Allergen Generator are created using artificial intelligence technology based on the Customer’s input data and current knowledge of Czech food legislation.

9.2. The Provider does not guarantee that the generated documents will fully meet all specific requirements of the relevant inspection authorities (Regional Hygiene Stations — KHS, Czech Agriculture and Food Inspection Authority — SZPI) in every individual case. The Provider undertakes to ensure that documents comply with the general requirements of applicable legislation at the time of their generation.

9.3. If an inspection authority (KHS/SZPI) raises comments on the generated documentation, the Provider offers the option of document revision based on specific inspector feedback — see Section 10 (Complaints).

9.4. The Provider is not liable for damages resulting from incorrect use of documents, the Customer’s failure to comply with hygiene regulations, or the use of outdated documentation that has not been updated by the Customer.

9.5. The Provider’s total liability for damages arising in connection with a specific order is limited to the amount of the price paid by the Customer for the respective service.

10. Complaints

10.1. The Customer is entitled to file a complaint about a service if the service was not provided in the agreed scope or quality.

10.2. Complaints must be submitted in writing by email to info@kitchenlaunchpad.cz, stating the order number and a detailed description of the defect.

10.3. The Provider will assess and resolve the complaint within 30 days of receipt at the latest. The Customer will be informed of the outcome by email.

10.4. Document revision based on inspector feedback: If an inspection authority (KHS, SZPI) raises specific comments on the generated HACCP documentation, Operating and Sanitation Rules, or allergen tables, the Customer may request the Provider to revise the documentation. The Provider will regenerate or formally supplement the document based on the feedback provided. This service is provided free of charge for the first revision, provided the request is made within 60 days of the document’s generation.

11. Personal Data Protection

11.1. The Provider processes Customers’ personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and Act No. 110/2019 Coll., on the processing of personal data.

11.2. Detailed information on data processing, purposes, data subject rights, and controller contact details are provided in the separate Privacy Policy document.

11.3. Input data entered by the Customer into forms (HACCP Generator, Operating and Sanitation Rules, Allergen Generator) are processed solely for the purpose of generating the ordered documents and are not shared with third parties, except for technical processing via the API service (Anthropic Claude) necessary for document generation.

12. GoPay Payment Gateway

12.1. Online card payments are processed through the GoPay payment gateway operated by GOPAY s.r.o., Company ID: 26046768, registered office: Planá 67, 370 01 České Budějovice, Czech Republic.

12.2. When paying by card, the Customer is redirected to a secure GoPay payment page where they enter their payment details. The Provider does not have access to the Customer’s payment information (card number, CVV code, etc.) — these details are processed exclusively by GoPay in compliance with the PCI DSS security standard.

12.3. Supported payment methods: Visa, Mastercard, Google Pay, Apple Pay, bank transfer.

13. Intellectual Property

13.1. All content on the website kitchenlaunchpad.cz (texts, graphics, logos, software) is protected by copyright and is the property of the Provider.

13.2. By ordering a service, the Customer obtains a non-exclusive licence to use the generated documents (HACCP plan, Operating and Sanitation Rules, allergen tables) for their own business purposes. The Customer has no right to resell or make the documents available to third parties for a fee.

14. Dispute Resolution

14.1. All disputes arising from these Terms are governed by the laws of the Czech Republic.

14.2. A Customer who is a consumer has the right to out-of-court resolution of a consumer dispute. The relevant body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (ČOI), registered office: Štěpánská 796/44, 110 00 Prague 1, Czech Republic, website: www.coi.cz.

14.3. Consumers may also use the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr.

15. Final Provisions

15.1. The Provider reserves the right to amend these Terms at any time. The new version of the Terms will be published on kitchenlaunchpad.cz. The Terms valid at the time of order submission are always binding for the Customer.

15.2. If any provision of these Terms is found to be invalid or unenforceable, this shall not affect the validity and enforceability of the remaining provisions.

15.3. Matters not governed by these Terms are subject to Act No. 89/2012 Coll., the Czech Civil Code, Act No. 634/1992 Coll., on Consumer Protection, and other applicable laws of the Czech Republic.

15.4. These Terms become effective on March 13, 2026.
